Terms of Service for Brush Nooli

These Terms of Service ("Terms") form a binding agreement between you ("you", "player") and Brush Nooli ("we", "us", "our"). The Terms govern your access to and use of the website at brushnooli.com and the free browser game known as Brush Nooli — also referred to as the viral cat brushing browser game, ginger cat simulator, red light green light cat game, and don't wake the cat game (the "Service").

By loading, browsing, or playing the Service, you agree to be bound by these Terms, our Privacy Policy, and our Disclaimer. If you do not agree, you must stop using the Service immediately.

Brush Nooli is rated suitable for general audiences. By using the Service, you represent that you are at least 13 years old (or at least 16 in jurisdictions where that is the digital-consent age). Players under that age must obtain verifiable parent or guardian consent before playing.

• You must have the legal capacity to enter into a binding agreement in your country.
• You must not be barred from receiving the Service under applicable law (e.g. sanctions or export controls).
• Parents and guardians are responsible for supervising any minor who uses the Service.

Brush Nooli does not require an account, sign-up, or download. High scores and gameplay preferences are stored locally in your browser using localStorage on the device you play from. Clearing browser data will erase those local records.

• Use bots, macros, scrapers, or automated tools to access, manipulate, or inflate scores.
• Interfere with the Service, its servers, or any network connected to it (e.g. DDoS, fuzzing, or rate-abuse).
• Attempt to bypass authentication, rate limits, ad serving, or other protective measures.
• Embed, mirror, or redistribute the Service or its assets without our written permission.
• Use the Service to harass, defame, or harm any person, or to violate any law.
• Submit malicious code, exploits, or content to any contact channel we operate.

We may investigate, suspend, or block access to the Service from any device or IP that we reasonably believe is engaged in prohibited activity, without prior notice.

The Service — including the Brush Nooli name, logo, character art, music, sound effects, source code, level design, and written content — is owned by Brush Nooli or its licensors and is protected by copyright, trademark, and other intellectual property laws.

What you may do

• Stream or record gameplay to share on YouTube, TikTok, Twitch, or other platforms, with credit and a link back to brushnooli.com.
• Share short clips or screenshots on social media.
• Link to any page on brushnooli.com from your own site.

What you may not do

• Reupload the full game, repackage it as your own, or use it in paid products.
• Use the "Brush Nooli" name or logo to imply endorsement or partnership.
• Train AI/ML models on our assets or content without our written permission.

If you believe content on the Service infringes your intellectual property, please contact us with the URL, a description of the work, and proof of ownership. We respond to valid takedown requests promptly.

If you contact us through the Contact page, by email, or through any other channel we operate, you grant us a worldwide, royalty-free, perpetual, non-exclusive license to use the content of your message to operate, improve, and promote the Service. You represent that any content you submit is yours to share and does not violate any third-party rights.

Brush Nooli is supported by ads. We use Google AdSense and may use other ad networks to display relevant ads. Third-party advertisers and analytics providers may set cookies or use device identifiers as described in our Privacy Policy.

Third-party links, ads, or embedded content shown on the Service are not endorsements. We are not responsible for the content, products, services, or privacy practices of any third party. You access third-party sites at your own risk.

• We do not warrant that the Service will be uninterrupted, timely, secure, or error-free.

OUR TOTAL CUMULATIVE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THE SERVICE WILL NOT EXCEED USD $50, OR THE AMOUNT YOU HAVE PAID US IN THE PAST 12 MONTHS (WHICHEVER IS GREATER). BECAUSE BRUSH NOOLI IS A FREE SERVICE, THIS WILL TYPICALLY BE USD $50.

You agree to defend, indemnify, and hold harmless Brush Nooli and its affiliates from any claim, loss, liability, damage, or expense (including reasonable legal fees) arising out of: (a) your violation of these Terms; (b) your misuse of the Service; or (c) your violation of any law or third-party right.

These Terms are governed by the laws of the operator's home jurisdiction, without regard to conflict-of-laws principles. You and Brush Nooli agree to attempt informal resolution by contacting us first. If a dispute cannot be resolved informally, it will be brought exclusively in the competent courts of that jurisdiction, except where local consumer-protection law gives you the right to sue locally.

• EU and UK consumers retain all mandatory consumer-protection rights of their home country.
• California residents may also contact the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs.
• Class actions and class arbitrations are not permitted; disputes are resolved individually.

We may update these Terms to reflect product changes, new regulations, or feedback. The "Last Updated" date at the top of this page always reflects the current version. Material changes will be highlighted on the homepage or via an in-game notice for at least 14 days before they take effect.

We may suspend or terminate your access to the Service at any time, with or without notice, if we reasonably believe you have violated these Terms. You may stop using the Service at any time. Sections 6, 7, 8, 10, 11, 12, and 13 survive termination.
